Terms of Service

1. Agreement

These Terms of Service ("Terms") form an agreement between you and Elixir Blend, the Cyprus-based operator of Elixir Boards ("Elixir Boards", "we", "us"). By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you use Elixir Boards for an organization, you confirm that you can bind that organization.

2. Accounts and access

You must provide accurate information, protect your login credentials, and promptly notify us of suspected unauthorized access. You are responsible for actions taken through your account and for managing workspace members, guests, roles, and permissions. You must be at least 16 years old.

3. Acceptable use

You may not use Elixir Boards to violate law or another person's rights; distribute malware or deceptive content; harass others; gain unauthorized access; evade service limits; scrape or disrupt the service; or publish spam. You may not use social-publishing features in a way that violates Meta's terms, platform policies, advertising rules, or community standards.

4. Your content

You retain ownership of content you submit. You grant us a limited, worldwide, non-exclusive license to host, copy, process, transmit, and display that content only as needed to operate, secure, support, and improve the service. You confirm that you have the rights and permissions necessary to submit and publish your content.

You control who can access your workspaces. Removing content may not immediately remove copies from collaborator devices, exports, audit records, or time-limited backups.

5. Facebook and Instagram publishing

Social publishing is an instruction-based tool. You choose the accounts, content, and publication time. You remain responsible for the content and for ensuring that connected accounts are authorized for your use.

Facebook and Instagram are third-party services operated by Meta. Their availability, review decisions, rate limits, formats, and policies are outside our control. A scheduled post may be delayed or fail because of token expiry, account restrictions, platform outages, media requirements, or other third-party conditions. Elixir Boards is not affiliated with or endorsed by Meta.

6. AI features

AI-generated output may be incomplete, inaccurate, or unsuitable. Review it before relying on or publishing it. You are responsible for decisions and content produced with AI assistance, and you must not use AI features for unlawful, harmful, or high-risk decisions without appropriate human review.

7. Plans and payments

Features and limits may vary by plan. Prices, billing periods, taxes, renewal terms, and cancellation options are shown at purchase. Unless law requires otherwise, fees already paid are non-refundable. We may change plans or prices prospectively with reasonable notice.

8. Our service and intellectual property

We and our licensors own Elixir Boards, including its software, design, branding, and documentation, excluding your content. We give you a limited, revocable, non-transferable right to use the service under these Terms. We may update, add, remove, suspend, or discontinue features, and we do not guarantee uninterrupted availability.

9. Suspension and termination

You may stop using the service at any time. We may restrict or terminate access when reasonably necessary to address a Terms violation, security risk, legal requirement, non-payment, or harm to the service or others. Where practical, we will provide notice and an opportunity to export content.

10. Disclaimers and liability

To the extent permitted by law, Elixir Boards is provided "as is" and "as available" without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not responsible for third-party services, user content, lost profits, lost opportunities, or indirect or consequential losses.

Nothing in these Terms excludes liability that cannot legally be excluded. Where liability can be limited, our aggregate liability relating to the service will not exceed the greater of the amount you paid us during the previous 12 months or EUR 100.

11. Governing law and contact

These Terms are governed by the laws of the Republic of Cyprus, without limiting mandatory consumer protections that apply in your country. Courts in Cyprus will have jurisdiction where legally permitted. Contact us at [email protected].
